Terms And Conditions

These Terms of Use govern access to and use of the ForsaTaw platform (mobile apps and website). By creating an account or placing an order, the user accepts the following conditions without reservation.

Definitions

  • Platform: ForsaTaw’s digital services.
  • Merchant: Professional or partner offering unsold product baskets.
  • User: Natural person booking unsold baskets via the platform.
  • Basket: A lot of food products sold at a discounted price.

Registration and Accounts

  • The user must be at least 18 years old or have parental authorization.
  • Provided information must be accurate; an ID may be required in case of a dispute.
  • ForsaTaw reserves the right to suspend an account in case of fraud or breach of terms.

Order Process

  1. The user selects an available basket.
  2. Payment is made on-site or via an authorized delivery person.
  3. After the pick-up time, the order may be automatically canceled; each merchant's policy is shown on their shop page.

Commitments of the Parties

  • Merchant: Ensure that products are fit for consumption upon delivery.
  • User: Collect the basket at the indicated time and check the products on-site.
  • ForsaTaw: Ensure the technical availability of the platform (target uptime: 99% excluding planned maintenance).

Pricing and Fees

  • Merchant subscription is set at 200 TND/year (monthly and quarterly plans available).
  • No service fees are charged on basket sales during the subscription period.
  • Basket prices are freely set by merchants.

Liability

ForsaTaw acts as a technical intermediary; the sale is directly concluded between the merchant and the user (contract for perishable goods).

ForsaTaw cannot be held liable for:

  • A product unfit for consumption,
  • A delay caused by the user or the merchant,
  • A case of force majeure.

ForsaTaw reserves the right to suspend a supplier account in case of proven violation of the contract for perishable goods.

Intellectual Property

All content (logos, texts, source code, databases) is protected. Any total or partial reproduction without written permission is prohibited.

Governing Law – Disputes

These Terms are governed by Tunisian law. In case of dispute, amicable mediation is preferred; failing that, the courts of Sfax have jurisdiction.
